In common law jurisdictions, legal professionals cite facts and legal principles from precedent cases to support their arguments before the court for their intended outcome in a current case. This practice stems from the doctrine of stare decisis, where cases that have similar facts should receive similar decisions with respect to the principles. It is essential for legal professionals to identify such facts and principles in precedent cases, though this is a highly time intensive task. In this paper, we present (...) studies that demonstrate that human annotators can achieve reasonable agreement on which sentences in legal judgements contain cited facts and principles. This article offers an anthropological perspective on autism, a condition at once neurological and social, which complements existing psychological accounts of the disorder, expanding the scope of inquiry from the interpersonal domain, in which autism has been predominantly examined, to the socio-cultural one. Persons with autism need to be viewed not only as individuals in relation to other individuals, but as members of social groups and communities who act, displaying both social competencies and difficulties, in relation to socially and culturally (...) ordered expectations of behavior. The article articulates a socio-cultural approach to perspective-taking in autism in three social domains: participating in conversational turn-taking and sequences; formulating situational scenarios; and interpreting socio-cultural meanings of indexical forms and behavior. Providing ethnographic data on the everyday lives of high-functioning children with autism and Asperger syndrome, the article outlines a cline of competence across the three domains, from most success in conversational turn-taking to least in inferring indexical meanings. Implications of these abilities and limitations are considered for theoretical approaches to society and culture, illuminating how members of social groups are at once shaped by, and are agents of, social life and cultural understanding. It has often been argued that charitable donations are not a sufficient response to global poverty; individuals need to address structural injustice. Proponents of the Effective Altruism (EA) movement have raised two main problems with this focus on structural injustice. In this paper, we respond to these concerns. The first problem raised by EA proponents is that focusing on structural injustice absolves individuals of any responsibility other than political ones. In response, we argue that discharging this duty requires more commitment (...) than EA defenders think, and we do so by framing individual responsibility in global structural injustice through the lens of Robin Zheng’s Role-Ideal Model (RIM). The second response given by EA proponents is that a focus on structural injustice does not provide concrete ways for any given individual to discharge such duties. To address this worry, we argue that RIM can be complemented with the Rawlsian account of moral maturation. This new framework makes it clear how individuals can form the right concept of justice and become responsible citizens who act in accordance with RIM. (shrink)

This essay explores the return of the subject in the computational context, which I address as a digital subject. This digital subject encompasses a digital identifier, correlations in data or a data profile, moving between biological characteristics and symbolic expression. I focus on the processes through which digital subjects are constructed by matching, correlating, modelling, as well as how they become enactive. The ways of pulling data together into a digital subject is often presented as a logic of fact, where (...) data is equated with documentary evidence. Instead, I propose the notion of the distance in which digital subjects are produced. Indexicality comes from outside of data, whereas the regard for the thick distance becomes a mark of the form of knowledge. I conclude by arguing for a posthumanities approach that establishes the distance while allowing for different subjects to be called upon. (shrink)

Confronted with an unprecedented scale of human-induced environmental crisis, there is a need for new modes of theorizing that would abandon human exceptionalism and anthropocentrism and instead focus on developing environmentally ethical projects suitable for our times. In this paper, we offer an anti-anthropocentric project of an ethos for living in the Anthropocene. We develop it through revisiting the notion of sustainability in order to problematize the linear vision of human-centric futurity and the uniform ‘we’ of humanity upon which it (...) relies. We ground our analyses in posthumanism and material feminism, using works by posthumanist and material feminist thinkers such as Stacy Alaimo, Rosi Braidotti, Donna Haraway and Jane Bennett, among others. In dialogue with them, we offer the concept of posthuman sustainability that decenters the human, re-positions it in its ecosystem and, while remaining attentive to difference, fosters the thriving of all instances of life. Ancient critics reproached Xenocrates for beginning his work on the dialectic with a discussion of voice, and until now the question why he did so has never been systematically explored. Neither do we know why Xenocrates counted syllables, as Plutarch reports, and how he arrived at such an implausibly high number. In the first part of this paper, I show that Xenocrates’ interest in voice was suggested by Plato’s discussion of letters in his later dialogues, such as the Theatetus, the (...) Sophist, the Statesman, and the Philebus. Second, a fragment from Sextus attributed to Xenocrates confirms that Xenocrates allowed for various ‘levels’ of elements, and that explains why Theuth’s method, recommended in the Philebus, is applied to syllables. Finally, I address the very possibility of knowing the actual number of syllables and words, and address some of the problems connected to the reconstruction of the mathematical argument. (shrink)

At the bedside, nurses are expected to be precise when they read indications on screens and on the bodies of patients and decide on the meaning of words framed by the context of acute care. In academia, although there is no incident report to fill when we misread or misrepresent complex philosophical ideas, the consequences of inaccurate reading include misplaced epistemological claims and poor scholarship. A long and broad convention of nursing phenomenological research, in its various forms, claims a philosophical (...) grounding in the ideas of Husserl, Heidegger, and other thinkers. But for nearly two decades, nurse phenomenologists' knowledge claims have been challenged by well‐informed criticisms, most notably by John Paley. At the heart of criticism lies an observation that Continental phenomenological thought is misrepresented in many nursing sources and that nursing phenomenology, both descriptive and interpretive, cannot appeal to the authority of either Husserl or Heidegger. Taking these criticisms seriously, I am asking, Is phenomenology after Paley possible? If misreading seems to be an issue, how can – or should – we read rigorously? My thinking through these questions is influenced by the ideas of Jacques Derrida. Under a condition of a play of language, of Derridian différance, when meaning is never self‐identical and never fully arrives, I suggest that one has to negotiate meanings through reading for differences. I develop this idea in relation to the methodological conventions of phenomenological nursing research and argue for a careful rereading of the whole field of phenomenological nursing research. Such rereading presupposes and necessitates interdisciplinary engagement between nursing and the humanities and interpretive social sciences. Greater familiarity with research practices of those disciplines that stress theoretical and writing rigour might make visible the limits of nursing research approaches and their quality criteria. An understanding of philosophical and theoretical works – a condition of quality scholarship – depends on our reading of both originary texts and contemporary literature from the humanities and the social sciences. This understanding, far from obliging researchers to always trace (often erroneously) their work to its philosophical roots, opens other, often more sound, methodological possibilities. (shrink)

In this commentary, I reflect on the differences between two independent citizen approaches to monitoring radiological contamination, one in Belarus after the 1986 Chernobyl nuclear accident and the other in Japan following the 2011 Fukushima Daiichi accident. I examine these approaches from the perspective of their contribution to making radiological contamination more publicly visible. The analysis is grounded in my earlier work, where I examined how we have come to know what we know about post–Chernobyl contamination and its effects in (...) Belarus, a former Soviet republic most heavily affected by the fallout. As I described in this study, much of what we know about the consequences of Chernobyl is based on the work of the Belarusian nonprofit Institute of Radiation Safety, “Belrad.” I compare Belrad’s approach to radiological monitoring with the work of the volunteer network Safecast, arguably one of the best-known citizen science projects in the world, which is working to monitor the scope of the post–Fukushima contamination. Through this comparison of approaches, I raise broader questions about a form of sensing practices—data-related practices of citizen science that make environmental hazards publicly in/visible. Although epidemiology as a scientific study of disease in populations claimed an independent disciplinary status already in the mid–nineteenth century, its history in the twentieth century can be seen as a continuous and often contentious attempt to define the field’s social and intellectual boundaries vis-à-vis a variety of neighboring scientific fields and public health practices. In a period dominated by laboratory biomedical sciences, epidemiologists repeatedly tried to spell out how their discipline met the requirements of scientificity despite its focus on (...) disease as a collective phenomenon and its reliance on nonlaboratory methods. This article asks about the relationship between the changing institutional and intellectual contexts of British epidemiological practice and the epidemiologists’attempts to define both science in general and epidemiology in particular. An examination of the epidemiologists’boundary-making endeavors is also used to reflect on the circumstances in which scientists engage in the discourse of disciplinary demarcations. (shrink)

The article is devoted to the decolonization of Ukrainian culture as an important factor of nation-building in the European perspective. At the same time, decolonization is a current trend in Western academic thought, which is embodied in social activism, in particular, in the wok movement and the culture of abolition. Postcolonial studies has become an intellectual battleground. These studies draw a new front line in the culture wars. Rethinking Western culture in light of its imperial expansionist past defines the goal (...) of decolonization. However, the tendency towards the politicization of vouk and the culture of cancellation. carries the risks of undermining the basic values of Western culture - freedom of thought and the rule of law, while the decolonization of Ukrainian culture has a different purpose. Unlike cultural decolonization in Western countries, cultural decolonization in Ukraine is aimed at legitimizing modern European values (Lisbon Agreement, 2007) by overcoming the «Russian-oriented» (Eurasian) tradition of thinking.Identifying the authentic contents of Ukrainian culture and refuting its imperial-Soviet interpretations is one of the main tasks of the decolonization of Ukrainian culture. The article offers a comparative analysis of Ukrainian and Western versions of cultural decolonization in order to avoid uncritical borrowings and ignoring the peculiarities of the Ukrainian context. The successful decolonization of Ukrainian culture requires the development of its 1) concept, 2) methods of theoretical substantiation, and 3) methods of practical implementation. The article states that the decolonization of Ukrainian culture becomes possible if its research strategies are deprived of colonial influences, which reveal indications of the imperial and Soviet scientific paradigm of social and humanitarian knowledge. An analytical scheme that differentiates among the various types of cognitive and social functions of citations is used as the basis for an analysis of the results of a questionnaire designed to probe the citing behavior of a group of scientists who had cited one of four papers originating from a single biochemical laboratory. Even when papers fall within a relatively well-defined research area and are based on research conducted within a single lab, groups of scientists to which a given (...) paper is of relevance can have quite distinct internal structures. We argue that the scientists'subjective reasons for citing a given work do not correspond with the actual argumentative uses of cited articles in citing texts. Scientists appear to regard the papers they cite as having a rather generalized significance even if in their citations they refer to very specific claims made in the original texts. The consequences of these findings for a theory of citation and for the use of citations in science studies are discussed. (shrink)

While various Kantian influences on Rawls have been discussed in the literature, these discussions have been limited to Part I of A Theory of Justice and consequently to topics concerning a priori ethical considerations and their consequences for political philosophy. In contrast to others who have interpreted Rawls’s Kantianism in this way, I show that what is also at the core of Rawls’s Kantian project in Theory is Kant’s theory of moral development. This theory of moral development, which Kant develops (...) in his Lectures on Pedagogy, Lectures on Anthropology, and Essays regarding the Philanthropinum, bears close conceptual ties to Rawls’s account of rational and moral maturation of the citizens of a well-ordered society in Theory Part III. These two philosophers share a similar approach to solving the problem of political stability – an approach grounded in the moral education of an individual. By looking at Rawls’s interpretation of Kant’s ethics in the Lectures on the History of Moral Philosophy, moreover, we can better understand Rawls’s proof for the possibility of the inherent stability of a well-ordered society. The role of bacterial variation in the waxing and waning of epidemics was a subject of lively debate in late nineteenth and early twentieth-century bacteriology and epidemiology. The notion that changes in bacterial virulence were responsible for the rise and fall of epidemic diseases was an often-voiced, but little investigated hypothesis made by late nineteenth-century epidemiologists. It was one of the first hypotheses to be tested by scientists who attempted to study epidemiological questions using laboratory methods. This paper examines how (...) two groups of experimental epidemiologists, the British group led by W. W. C. Topley and Major Greenwood, and an American group directed by Leslie T. Webster at the Rockefeller Institute, studied the role of variations in bacterial virulence in the course of laboratory epidemics of mouse typhoid. Relying on Ludwik Fleck’s concept of thought styles and thought collectives, the paper analyzes the fundamental conceptual differences between these two groups of researchers and analyzes the kinds of innovations they introduced as they attempted to integrate bacteriological and epidemiological approaches. The paper shows that the stylistic differences between the two groups can be understood better in the context of the institutional histories and disciplinary relations of epidemiology and bacteriology in the two countries. This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.

The article focuses on the crucial changes that science as an established social institution and an epistemological enterprise is undergoing, the key one is the loss of its monopoly on the production of socially useful knowledge and gradual transformation into something new, which, due to institutional and cultural reasons, we continue to call ‘science’. We suppose that the most appropriate conceptualization of the new phenomenon, which is replacing science as an institution, is “technoscience”, since the technical component in scientific practices (...) has now taken a dominant position and technology production has become more important than fundamental knowledge. Technoscience has at least two sources: 1) capitalization of scientific activity that has led to classical science has been replaced with technoscience developing on first-priority funded applied research; 2) theorization and autonomy of the techno sphere, which have resulted in instrumentalization of all levels of knowledge production as well as in technological / symbolic construction of reality and tangled ontology of technoscientific objects. We discuss both of these sources, with particular attention being paid to such trends as epistemic strategies transformation, modified reality, social sciences and humanities conformation to technoscience norms, and knowledge bearers egalitarianization. A crucial transformation of both science itself and its position in society breaks inevitably a demarcation line that separates scientific knowledge from other types of knowledge while promotes the replacement of scientific theory with discourses. Apparently, in “technoscience” an ethos of its own is being formed, where interaction with the “external environment” (with other social spheres) is crucial. In this context, scientific activity is becoming more and more transepistemic, transinstitutional practice, and accordingly ceases to be guided by the classical scientific ethos determined by the goals and objectives of academic community itself. In the aftermath of the Fukushima power plant disaster, autoradiography became an increasingly widespread artistic technique for producing cameraless photography. By exposing photographic film directly using contaminated objects and materials, contemporary artists autoradiograph the geopolitics and local histories of atomic contamination due to bombing, testing, nuclear reactor explosions, mining or uranium disposal cells. In my article, I discuss the implications these autoradiographic works have for the concept of photography by drawing on Timothy Morton’s notion of hyperobjects. Being hyperobjective, radioactivity confronts (...) human beings with a vast non-human temporality, which, in turn, necessitates a shift in our understanding of photography. While photo theory has often been modelled on snapshot photography, privileging instantaneity and pastness, autoradiography is a durational and pluri-temporal procedure that points emphatically towards the future and invites us to reconceptualize the basis of photographic ontology. The issue of benefits in international clinical research is highly controversial. Against the background of wide recognition of the need to share benefits of research, the nature of benefits remains strongly contested. Little is known about the perspectives of research populations on this issue and the extent to which research ethics discourses and guidelines are salient to the expectations and aspirations existing on the ground. This exploratory study contributes to filling this void by examining perspectives of people in low-income South (...) African communities on benefits in international clinical research. Twenty-four individuals with and without experience of being involved in clinical research participated in in-depth interviews. Respondents felt that ancillary care should be provided to clinical research participants, while a clinical study conducted in particular community should bring better health to its members through post-trial benefits. Respondents' perspectives were grounded in the perception that the ultimate goal of international clinical research is to improve local health. We argue that perspectives and understandings of the respondents are shaped by local moral traditions rather than clinical research specificities and require attention as valid moral claims. It is necessary to acknowledge such claims and cultural worlds from which they emerge, thus building the foundation for equal and embracing dialogue to bridge different perspectives and handle contradicting expectations. The author proposes an alternative view to the consideration of the writer’s literary heritage from the position of jingoism and propagation of the civilizing mission of the British Empire, which can still be encountered in academic research. The analysis of Plain Tales from the Hills suggests that the praise of British imperialism was not the main idea of Kipling’s (...) early works. The researcher comes to the conclusion that Kipling did not regard India as a conquered barbarous land which the British people had to civilize. This remote exotic country became a motherland for a representative of Anglo-Indian society, who was born in Indian environment. Kipling’s love for India is felt in his strive to give a detailed description of exotic locations and ethnographic peculiarities and even to restore the manner of speech of Indian population. The reader of Plain Tales from the Hills can perceive the author’s respect for the English and Indian people, working in harsh climate, his interest and great sympathy with the aboriginal population, living in hard social conditions under the British rule. The sarcastic remarks of his characters, which reflect Kipling’s doubt in the beneficial role of the British Empire in the lives of the Indian people, finally refute the statement about the writer’s glorification of the imperialistic policy of Great Britain as the main aim of his creative art. I could use the company of younger people.” It had been about a year since I’d first been invited to these (...) Thursdays —monthly literary and musical soirees Marguerite hosted in her living room. Helen had been a regular at Marguerite’s for several decades; the two women were close contemporaries and each a celebrity in her own field. Helen was scholar of the English Romantics at the same university where Marguerite had taught Flaubert, Zola, and Balzac, and where I was now a junior faculty member in the English department. I’d heard of Professor More long before I met her: she lectured at the university from the 1960s until being forced into retirement in 2006 ostensibly due to age. She had a reputation as a militant feminist who eagerly engaged in battles about appointments and promotions, and her politics could have had something to do with it. “Are they sure it was a suicide?” In person Helen was a quiet, reticent woman with a sly, sarcastic sense of humor, and the idea that she might’ve committed suicide seemed outlandish. When young children learn to use language, they start to use their hands in co‐verbal gesturing. There are, however, considerable differences between children, and it is not completely understood what these individual differences are due to. We studied how children at 4 years of age employ speech and iconic gestures to convey meaning in different kinds of spatial event descriptions, and how this relates to their cognitive abilities. Focusing on spontaneous illustrations of actions, we applied a semantic feature (SF) analysis (...) to characterize combinations of speech and gesture meaning and related them to the child's visual‐spatial abilities or abstract/concrete reasoning abilities (measured using the standardized SON‐R test). Results show that children with higher cognitive abilities convey significantly more meaning via gesture and less solely via speech. These findings suggest that young children's use of cospeech representational gesturing is positively related to their mental representation and reasoning abilities. (shrink)

The Ukrainian–Russian conflict of 2013–2017 is characterized as ‘hybrid’ warfare, with a crucial role of informational component. Using ideological discourse analytic tools, this article demonstrates how two prominent Russian TV channels shaped the persuasive message, creating strong unity and mobilizing a high level of support among the national audience. Based on legitimation and de-legitimation patterns, Channel One and Russia-1 built ideologically polarized opposition between ‘Our’ and ‘Their’ sides of the conflict. The wide range of editorializing tools, socio-cultural and historical Soviet-time (...) constructs, and references to gay culture served to promote one group and to debase the opposition. Close institutional ties between government and media in Russia sustain multiplicity and intertextuality of ‘general line’, thus eliminating discordant interpretations. The article shows strong evidence that the analyzed TV news programs present a typical illustration of ideological discourse, exploited by the Russian government in order to achieve its political goals. In Spain, the introduction of the new Diploma in Nursing in 1977 saw the role of nurses shifting from that of medical assistants with technical skills to being independent members of the healthcare team with specific responsibility for providing professional nursing care. Here, we analyse the evolution of the nursing profession in Spain following the transfer of nurse education to universities, doing so through interviews with the first generation of academic tutors. This was a qualitative study using the method of (...) analytic induction and based on the principles of grounded theory. Participants were selected by means of theoretical sampling and then underwent in‐depth interviews. Steps were taken to ensure the credibility, transferability, dependability and confirmability of data. The main conclusion of the analysis is that there is a gap between a theoretical framework borrowed from the Anglo‐American context and a nursing practice that, in Spain, has traditionally prioritised the application of technical procedures, a role akin to that of a medical assistant. It is argued that a key factor underlying the way in which nursing in Spain has evolved in recent decades is the lack of conceptual clarity regarding what the role of the professional nurse might actually entail in practice. This work proposes an understanding of deductive, default and abductive reasoning as different instances of the same phenomenon: epistemic dynamics. It discusses the main intuitions behind each one of these reasoning processes, and suggest how they can be understood as different epistemic actions that modify an agent’s knowledge and/or beliefs in a different way, making formal the discussion with the use of the dynamic epistemic logic framework. The writer’s sketch Anglo-Indian Society and his collection of short stories Plain Tales from the Hills depict the characteristic features of Anglo-Indians’ worldview and lifestyle, which are revealed and analyzed by the author of the article. Special attention is paid to biographical factors (...) influencing the author’s choice of Anglo-Indian topic at the beginning of his writing career. The researcher concludes that Kipling presents in his works an outline of Anglo-Indian society which emerged from the writer’s observations of Anglo-Indians’ lives during his work as a reporter. Striving for credibility in consideration of advantages and shortcomings of Anglo-Indian worldview and lifestyle, the author tries to occupy the position of the unconcerned observer, being capable of assessing the situation with fresh mind. Kipling disguises himself under the image of the hero-narrator, being either a tourist traveler from abroad, or a reporter, accustomed to collecting factual material for the local paper, in such a way receiving an opportunity to speak ironically and sometimes even sarcastically about certain models of behavior, accepted by Anglo-Indians. ]]>. Freedom to Believe is a powerful collection of philosophical and religious essays by a modern poet of distinction. It introduces a highly original and controversial thinker to the Western reader. Olga Sedakova's central philosophical thought lies in the notion of existential freedom in its association with the liberating power of the arts, especially poetry. These convictions place her firmly in the Russian and European classical cultural traditions, which, in turn, have deep roots in Christianity. Devoutly Orthodox yet fiercely independent (...) in her thinking, Sedakova's ecumenical humanism places her in opposition to both the "new left" and modern fundamentalism. Indeed, Sedakova's "conservatism" is more genuinely new than the so-called radicalism of the postmodernists, as she castigates "old totalitarianism" and new commercialism alike, in the name of a new cultural poetics and politics. All existent beings are in relation to one another: with this statement Avicenna seems to affirm the idea of an ontological context. But in what sense should we conceive this ontological context and in what sense could we apply it to the God-world relationship? In the attempt to answer both questions a brief analysis of Avicenna’s conception of relation and of causality as relation is offered.

The article is dedicated to highlighting the concepts of humanism, neohumanism, posthumanism, transhumanism, their reading through the prism of pedagogical science and practice. The text is based on analysis of Ukrainian, French, and Polish sources, as well as own considerations. It has been found that the classical interpretation of humanism during the last decades has been subject to revision by various researchers due to the growing contradictions between the social, economic, and spiritual needs of society and the consideration of humanism (...) with its anthropocentric attitude towards man as the measure of all things. It was found that they led to an expanded and modified understanding of it, which was called neohumanism (new humanism). The article describes the researchers’ interpretation of neohumanism, which is based on moral and ethical ideas and ideals that relate to philosophical, ecological, pedagogical and other aspects of human life. It was noted that because of the sharp growth of new technologies, two concepts critical to humanism/ neohumanism emerged – posthumanism and transhumanism. The text reveals the concept of posthumanism, which, according to the researchers, considers man in unity, merging with machines, technological devices, that is, human and non-human. The main characteristics of post-humanist trends are provided, which testify to the gradual disappearance of man as an active and self-sufficient effective person. It is noted that, accordingly, transhumanism, as a radicalized branch of posthumanism, is focused on the use of technologies with the aim of creating a physically and mentally perfect person (Homo Perfectus), when the difference between man and machine is erased. It is shown how these processes affect the modern education system, which absorbs new technologies at an accelerated pace, replacing its traditional tools for teaching reading, writing, arithmetic, aimed at the formation of «long» memory, with technological devices. The article also raises the issue of neo-humanism, which is biocentric in nature, and in the pedagogical aspect manifests itself as a humane attitude towards nature, living beings, primarily animals. Such a trend becomes especially relevant in the context of ecocide caused by Russia’s military actions against Ukraine. A conclusion was made about the need to get acquainted with these processes, taking them into account for the development of the modern domestic educational space. (shrink)

L’article propose l’analyse de trois formes de manifestation de ce que nous avons appelé l’implicite argumentatif : à visée discursive, à visée sémantique et à visée lexicale. Dans la perspective théorique de la Sémantique des Possibles Argumentatifs, nous avons défini ce phénomène sémantico-discursif, comme la reconstruction, dans l’interprétation du sens d’un énoncé ou d’un ensemble d’énoncés, d’un élément signifiant ou d’une configuration d’éléments signifiants relevant de la nature argumentative de la signification d’un mot, présent ou absent de cet énoncé ou (...) de cet ensemble d’énoncés. L’article défend, illustre et argumente les fondements sémantiques de ces trois types d’implicite argumentatif, ancrés dans le potentiel discursif de la signification des mots et dans le potentiel du sens produit dans les instances de parole, de proposer des significations lexicales régénérées. Este artículo explora la cobertura como una estrategia de cortesía utilizada para parecer humilde en el discurso académico. Se estudia la cobertura como la principal estrategia utilizada para mostrar cortesía en la prosa académica. Los estudios han explorado la cobertura desde diferentes perspectivas. Sin embargo, hay pocos estudios que se centren en los patrones léxicos de cobertura en el discurso académico. Con este fin, hemos construido un corpus integrado por 412 resúmenes que acompañan a artículos de investigación, todos ellos en (...) la disciplina de la lingüística, la jurisprudencia, la ingeniería y la medicina. El marco teórico es el concepto de la cobertura propuesto por Myer (1989). La taxonomía propuesta por Vartalla (2001) se utilizó para analizar las herramientas de la cobertura léxica. El análisis cuantitativo indicó que la distribución de patrones léxicos usados para mostrar cortesía difería en cuatro disciplinas. (shrink)

The aim of this paper is to show, contra the right-libertarian critique of social justice, that there are good reasons for defending policies of social justice within a free society. In the first part of the paper, we will present two influential right-libertarian critiques of social justice, found in Friedrich Hayek's Law, Legislation and Liberty and Robert Nozick's Anarchy, State and Utopia. Based on their approach, policies of social justice are seen as an unjustified infringement on freedoms of individual members (...) of a society. In response to this critique, we will introduce the distinction between formal and factual freedom and argue that the formal principle of freedom defended by Hayek and Nozick does not suffice for the protection of factual freedom of members of a society, because it does not recognise (1) the moral obligation to help those who, without their fault, lack factual freedom to a significant degree, and (2) the legal obligation of the state to protect civic dignity of all members of a society. In the second part of the paper, we offer an interpretation of Kant's argument on taxation, according to which civic dignity presupposes factual freedom, in order to argue that Kant's justification of taxation offers good reasons for claiming that the state has the legal obligation to protect factual freedom via the policies of social justice. In this paper I argue that descriptive content associated with a proper name can serve as a truth-conditionally relevant adjunct and be an additional contribution of the name to the truth-conditions. Definite descriptions the so-and-so associated by speakers with a proper name can be used as qualifying prepositional phrases as so-and-so, so sentences containing a proper name NN is doing something could be understood as NN is doing something as NN (which means as so-and-so). Used as an adjunct, the descriptive (...) content of a proper name expresses the additional circumstances of an action (a manner, reason, goal, time or purpose) and constitute a part of a predicate. I argue that qualifying prepositional phrases should be analyzed as predicate modifiers and propose a formal representation of modified predicates. The additional truth-conditional relevance of the descriptive content of a proper name helps to explain the phenomenon of the substitution failure of coreferential names in simple sentences. The article presents a study of gift-giving practices in the context of the development of modern biomedicine and shows their relationship to the realization of epistemic virtues. In biomedicine, the gain and production of knowledge (the gift of knowledge) is often grounded in bodily gift (sacrifice) and donor practices. The latter are associated with a number of mishaps in the history of biomedicine, reflecting the violation of moral norms in the process of obtaining scientific data and demonstrating the need for (...) a clear differentiation of intellectual and moral virtues. An important factor in the formation of the epistemic norms of modern biomedicine has been the transformation of the values of scientific knowledge from practices of coercion to giving. As a result, the involuntary sacrifice of biomaterials to science was replaced by voluntary practices of somatic giving and informational exchange that determine the process of mutual recognition in science. It is shown that gift-giving in science is closely associated with intellectual virtues, with intellectual generosity characterizing the idea of openness in science and scientists’ intention for production and constant growth of knowledge, and can also be related to the idea of altruistic service to science, involving the exchange of received scientific data and access to free information in the network space. A number of examples of the modern digital gift ethos and the implementation of the principles of openness of knowledge and knowledge exchange in the context of the creation of biomedical expert digital platforms, the formation of social scientific networks – platforms with open access to scientific information, the development of the phenomenon of “garage” science and other “zones of exchange” experience are considered. After Husserl?s transcendental turn and the discovery of the correlation between consciousness and the world the concept of the noema becomes one of the constant leitmotifs of Husserl?s philosophy. My paper will be devoted to the clarification of this concept and its implications for Husserl?s theory of sense. The leading question will be: How can the noema play the role of both the sense and the objective correlate of the intentional act? I will start with presenting the problematic of sense (...) in Husserl?s phenomenology from the Logical Investigations to the Ideas I. The central part of my paper will be devoted to the influential debate regarding the interpretation of the noema. Finally, I intend to point out the most important ways in which the notion of the noema becomes enriched in later Husserl?s philosophy, as well as the difference between linguisitic and non-linguistic sense, based on the Analyses Concerning Passive and Active Synthesis. I hope to show that Husserl?s phenomenological theory of sense offers a valuable alternative to the exclusively language-oriented theories of sense. (shrink)

In this paper I concern myself with The Superman Puzzle. I argue that the descriptive content associated with proper names, besides determining the proper name's reference, function as truthconditionally relevant adjuncts which can be used to express a manner, reason, goal, time or purpose of action. In that way a sentence with a proper name NN is doing something could be understood as NN is doing something as NN. I argue that the substitution of names can fail on modified readings (...) because the different descriptive content of proper names modifies the main predicate differently. Here I present a formal representation of modified predicates which allows one to model intuitively the different truth-conditions of sentences from The Puzzle. (shrink)

Ethical guidelines for psychologists are meant to stimulate and help psychologists to act appropriately with respect to clients, colleagues, and other individuals involved in their professional relations. This paper focuses on the similarity of codes of ethics of psychologists in European countries in general, and on specific ethical dilemmas in the area of work and organizations in particular. First, an overview is given of the development of ethical guidelines in Europe and the USA. Second, the results are presented of a (...) survey by E-mail amongst members of the European Federation of Psychologists’ Associations (EFPA) to identify the differences and similarities between ethical guidelines of the affiliate members. Third, the potential dilemmas of stakeholders in work and organizational assessment are addressed. Finally, the results of a survey among Dutch selection psychologists are presented. The purpose of this study was to examine a possible tension between normative behavior and attitudes about normal behavior. It was concluded that ethical guidelines of European countries cover comparable (sub-)principles and that there are indications that individual psychologists agree with the written principles. This article assesses the potential for basic income to become a tool for empowering women in the household and in the workplace. Recent debates among feminist political theorists indicate that it is not obvious whether basic income has the potential to push our society toward greater socioeconomic gender justice. I show that arguments for and against basic income put forward by feminist theorists rely on implicit assumptions about how women's work should be conceived—assumptions that are not shared among all of (...) them. I also argue that these beliefs can be sorted into two dichotomies: one concerned with the suitability of remuneration for caregiving, the other with the question of who should be responsible for caregiving. I conclude by explaining the possible causes of the divergences in the views of feminist supporters and critics of UBI, and by recommending ways to arrive at common conceptual grounds. (shrink)

This article aims to be what Jasbir Puar referred to as ‘an unfolding archive’. It makes a critical intervention at a historical crisis point as it is unfolding. It sets out to examine the logic that writes the relations between bodies, borders and kin during the political crisis that transpired at the border of Belarus and Poland in 2021. I think of this logic in terms of a ‘grammar’, drawing on the idea articulated by Hortense J. Spillers, where ‘American grammar’ (...) fleshes out the connection between slavery, kinship, nation-building and the processes of gendering. I examine the rubrics of the hegemonic national grammatics in contemporary Poland, which establishes who counts as kin and who belongs to the nation in the context of the border crisis. I offer the concept of ‘declining’ kinship to seek generative (im)possibilities to articulate affinities and solidarities running against the dominant system of reproductive nationalism. (shrink)

Aesthetic theory distinguishes different approaches to understanding the sensory and logical. The author agrees with I. Kant’s theory that sensory perception is subjective and the imagination is given the opportunity to invent fictional characters that do not exist in real life. Digital technologies make it possible to revive and introduce such characters into an artistic performance. This process becomes possible with the help of computer algorithms that are used to create art practices. There are many contradictory publications where there is (...) no understanding of the technological process of the task at hand, for example, that it is possible to write a program that will “teach machine aesthetics” using pictures. Therefore, the author turns to three technological solutions (virtual reality, augmented reality and artificial intelligence or neural networks) and examines, using the example of existing programs and applications, how the process of interacting computer algorithms of artistic creativity with the imagination and skill of stage work directors (play, opera, choreography). The author solves this issue within the framework of algorithmic aesthetics, which considers the process of communication, but unlike media theory, considers the process of information exchange in binary code. The algorithms by which the written programs operate do not create a “code spirit”, but allow the creation of tools for artistic creativity and the development of the skills of talented people. Introduction. The intensity of the visual media influence in the format of films and TV series on cultural life, reaching its peak in the era of streaming television, poses the task for the humanities to study the visual type of thinking, visual consciousness, which is different from the classical visualization of verbal thinking in the plastic arts. If a researcher intends to derive from a film or TV series, a value system, a cognitive strategy that is relevant for its time, (...) the visual environment may turn out to be no less eloquent for him than the dramatic action taking place in it. The character and quality of this environment are made up of many sensory elements: light, color, movement and its choreography, sound, space, subject referents, etc. Taken together, they represent not so much an articulation of the author’s thought, but a way of specifically visually thinking through this thought. The complex structure of visual-mental environments requires extensive and systematic research work. In this article we take one of the most obvious substantive aspects of the visible: the vestimental strategy of the film. The purpose of the article is to identify patterns marked by subject (vestimentary) characteristics that are redundant in relation to the dramatic action by comparing the visual environments of films from different decades of the 20th century; using the code of cultural universals that assign the function of sociocultural and ethical regulation to the concept of “clothing” [1; 3; 5; 10; 15], to identify the meaning of these patterns in the context of the ethical thinking of the era. Methods. During the study, the authors use general scientific methods of analysis and synthesis; the method of phenomenological reduction, which makes it possible to record the sensory qualities of object-spatial screen environments; a hermeneutical method that allows, on the basis of visible sign structures, to identify the essential intentions of a visual image. In view of the task, it turned out to be necessary to involve some concepts of narratology (in particular, the concept of focalization) and methods of corpus analysis adopted in linguistics. The scientific novelty lies in the fact that we approach the visual source from a philosophical and cultural perspective, considering the visual environment of the film as a form and method of actual sociocultural or philosophical thinking, which has specific (visual) tools. This approach allows us to draw conclusions based not only on individual films, but also on large source databases. Results. During the analysis, the authors applied the tools of modern visual studies and the conceptual basis of socio-philosophical ethics to cinematic texts of the 20th century. This made it possible to discover visual patterns common to films of some decades of the 20th century, namely: the 1930s, 1950s, 1990s, and connect them with the ethical issues of time. Conclusions. Analysis of source databases that include cinematic texts can be carried out through a systematic analysis of the visual environments presented on the screen. At the same time, dominant visual patterns characteristic of a particular era can be identified and described. Such a dominant determines the emphasis in the figurative whole and reveals important aspects of philosophical and cultural thought relevant for its time, including ethical thought. (shrink)

The issue of religious freedom while serving a sentence of imprisonment often occupies scientists from around the world. Basically, they agree that a prisoner, regardless of the act for which he or she has been convicted, has the right to religious freedom. Problems are posed, however, by the question of delimiting this freedom, especially at the level of the right to practise a chosen religion during prison isolation. The decisions of international tribunals and national courts are not uniform owing to (...) the generality of the rules governing this issue. The initial research question that we pose is this: how does society perceive the right to religious freedom in prisons? Does a convict have the right to demand respect for the rules of his or her religion regarding diet, clothes, appearance and participation in religious services? We look for answers to these questions in research conducted in Polish society, one that is confronted by international regulations. (shrink)

While Kant’s account of humankind’s rational progress has been widely discussed, his views about the way in which this progress might have begun and the circumstances surrounding this beginning have been largely neglected. Implicit in such an omission is the assumption that Kant does not say much about the very beginning of human history or that whatever he says is of little philosophical value. This paper challenges these assumptions. I reconstruct Kant’s account of the emergence of reason by looking at (...) his various conjectural and more literal remarks about our species’ transition from mere irrational animals into primitive human beings possessing a rudimentary form of rationality. Next, I show how this account fits with Kant’s broader view of humankind’s rational progress and its subsequent stages. By doing so, I elucidate Kant’s guidelines for achieving this progress in the future by unifying them with his regulative view of reason’s past. (shrink)

Se hace referencia al programa de Filosofía para Niños del filósofo Matthew Lipman y al valor de su proyecto educativo, como también al aporte de otros filósofos, especialmente el de Walter Kohan, que nos permiten pensar la (...) relación entre filosofía, educación e infancia con mayor complejidad. This paper is a novel attempt at reconstructing Kant’s account of self-consciousness in the first Critique by making evident its gradual expository progression, and at identifying the epistemic status of the two modes of self-consciousness: pure and empirical. I trace the gradual exposition of theoretical self-consciousness across three crucial parts of the book: the Transcendental Deduction, the Refutation of Idealism, and the Paralogisms of Pure Reason. In doing so, I show that the account of theoretical self-consciousness is not presented to (...) us all at once, but is progressively expanded and filled in. I also emphasize the importance of the distinction between the subject’s awareness of its existence, “Dasein”, and of its existence, “Existenz”. I conclude by discussing Kant’s preliminary remarks about practical self-consciousness in the Paralogisms, which bear an important relation to theoretical self-consciousness. (shrink)
